Consumer and retail disputes
Our experienced dispute resolution lawyers understand the risks involved in claims arising out of the sale and purchase of goods and services faced by both businesses and consumers.
Consumers who purchase goods or services from sellers, retailers or traders who are acting in the course of their trade, profession or business have a wide range of rights and remedies available to them in the event that those goods or services are not of satisfactory quality or fit for purpose. Also, rights and remedies are available to consumers who have purchased products online and have therefore not had the opportunity to examine the goods only to find that a fault or misdescription comes to light after delivery.
How we can help
When a consumer feels that there is a problem with the goods or services they have purchased, it is important that action is taken promptly and properly to address the dispute with the seller. An informed approach by a consumer who is aware of their rights often achieves and swift and satisfactory resolution of the problem.
Consumers can also call on our comprehensive expertise as we offer individuals specialist advice on the options available to them in disputes arising out of contracts for the sale of goods, supply of services, hiring of goods, credit purchases, distance selling regulations, auctions, and contracts with insolvent traders. We have vast experience in assisting consumers with litigation where remedies are sought against traders can include rejection, repair or replacement of goods, and compensation for damage caused by faulty goods. However, for reasons of cost proportionality, we are unlikely to be able to assist consumer with disputes concerning low-value claims (e.g., disputes about a defective electrical item).
We also have extensive experience advising local, national, and international retail brands and distributors covering a wide range of retail businesses on matters including commercial transactions, consumer contracts, product liability, and brand protection.
We aim to advise retailers on their legal position quickly and efficiently so they can manage disputes with their customers in accordance with the needs of their business before they escalate and with the minimum disruption to their operations and brand.
Our experienced Dispute Management team have a track record of acting for consumers and retailers alike and can offer a commercially-focused approach to resolving such problems.
