Trading Standards operate throughout the UK and are specially trained teams that are usually created by a Local Authorities. They enforce criminal laws and regulations intended to protect consumers, businesses and the general public. Lupton Fawcett is experienced in advising clients both in terms of product recall procedures and regulatory investigations.
Our specialist team has long-standing relationships with experts in various product areas and such expertise has allowed us to successfully defend a number of clients where prosecutions have been instituted by Trading Standards.
Trading Standards officers will investigate alleged offences and breaches and have many of the same powers as the Police to do so. You may be invited to attend an interview under caution and if this is the case then you should seek immediate expert advice as what you say in that interview may have a significant impact on the outcome of an investigation or prosecution.
By having us as your legal representative you get the benefit of solicitors who understand what is involved in investigations and unlike many firms, are fully conversant with Police Station procedure.
If you or your business are prosecuted by Trading Standards this can be through the criminal courts and can result in a criminal conviction. A criminal conviction is a serious matter for your business and can easily cause substantial reputational harm along with financial penalties and in some cases, imprisonment.
If you or your business is being investigated then you should seek immediate expert advice from our team of specialist lawyers.
Case study - contested trial defence for client in children's toy market - accused of breach of flammability requirements
Our client, who has a major presence in the children's toy market, was accused of selling toys which were in breach of flammability requirements. The case was ultimately prosecuted in the Magistrates' Court. Following a contested trial which led to experts being called on behalf of prosecution and defence, our client was acquitted of all offences they had been charged with and the Court made an order for their costs to be paid out of Central Funds.
